Halle Berry and Olivier Martinez’s Custody Battle Over Son Maceo Escalates With Restraining Order

A new court filing and a temporary restraining order have intensified the long running custody dispute between Halle Berry and ex husband Olivier Martinez over their 12 year old son.

Halle Berry and her ex husband Olivier Martinez are once again in a public legal fight over their 12 year old son, Maceo, and this latest round has brought a temporary restraining order into the mix.

According to court documents, Martinez alleges that a disagreement over a virtual reality game at Berry’s home on September 26 escalated into a physical confrontation, which he says is part of a larger pattern of conflict. He is now seeking sole custody of Maceo. It’s important to note that none of these allegations have been proven in court, and Berry has firmly disputed them.

Berry’s attorney, Marina Beck, didn’t hold back in response, calling the filing “entirely meritless and deliberately misleading.” Berry’s camp has reportedly countered with its own set of claims, accusing Martinez of repeatedly violating existing court orders and interfering with therapeutic and educational support put in place for their son, describing his conduct over recent months as volatile and controlling.

The legal back and forth has already produced real consequences. On October 1, a Los Angeles County judge granted Martinez a temporary restraining order, requiring Berry to stay roughly 100 yards away from him, though her contact with Maceo remains limited to court ordered visitation rather than cut off entirely. A request for sobriety monitoring was reportedly denied for lack of sufficient evidence, and the court has also ordered the two into confidential custody mediation.

This isn’t the first time this blended family has found itself at the center of a messy, public legal clash. Back in 2012, Martinez was involved in a Thanksgiving altercation with Gabriel Aubry, the father of Berry’s daughter Nahla, that also turned physical and drew significant headlines at the time. That history adds extra weight to how closely this current dispute is being watched.

The case is set to return to court on October 16, when custody arrangements and the current restrictions are expected to be reviewed further. For now, the allegations on both sides remain just that, allegations, as a family once again works out deeply personal matters in a very public courtroom.
